Note to Kagan: You should NOT defer to Congress and the American people

You should honor the foundations for governance set down by our founding fathers and use your potential as a judge TO NOT legislate from the bench. Your remarks are dangerously populist and run totally counter to the very idea, the precepts, by which this REPUBLIC's citizens expect a Supreme Court Justice to adjudicate questions of constitutionality.
You, Ms. Kagan, have a full body of work found in the varied writings of our founding fathers along with the Federalist papers. Not to mention 200 plus years of legal precedent case history. For you to say you would defer to CONgress and the American People means that you are willing to expose those same people to the whim and fancy of a fickle crowd, prone to anger and irrationality. Perhaps a review of such populist notions would help you? How about, "...let them eat cake!"
To you congress critters in the Senate, I hope you consider Kagan's nomination long and hard and remember that she could sit on that seat for a very long time. Can your children or their children afford to have and "activist judge" on the Highest Court in the land?
I say we can not.
